Terms of use

These terms of use (the "Terms of Use") govern access to and use of https://jybly.ma (the "Site"). By browsing the Site or creating an account, the user accepts them.

2. Access

The Site is free to access for any user with an Internet connection, whose costs remain the user's responsibility. JYBLY strives to keep the Site available but may interrupt it for maintenance, updates or security reasons without liability.

3. Account

Accounts are reserved for adults. The user provides accurate information, confirms their e-mail and phone, keeps their password secret and informs us immediately of any unauthorised use. One account per person is allowed.

4. Rules of use

The user undertakes not to:

• use the Site for fraudulent or unlawful purposes, in particular by submitting forged proof of payment or ordering with a third party's payment means without their consent;
• use robots, scripts, scrapers or any automated means to query the Site, extract data from it or bypass its protections (including the anti-bot check);
• harm the security or proper functioning of the Site (intrusion, overload, spreading viruses);
• impersonate a third party or post insulting, defamatory or unlawful content in forms and messages.

In case of breach, JYBLY may suspend or close the account, cancel pending orders (refunding amounts not yet committed) and report the facts to the competent authorities.

5. Account suspension and blocking

JYBLY may, for any legitimate reason, suspend or block an account and refuse new orders, in particular in case of:

• forged, altered or reused proof of payment, or any other attempted payment fraud;
• abusive payment disputes (chargebacks) for an order that was performed;
• repeated refusals of delivery or parcels left uncollected without valid reason;
• false identity, inaccurate contact details or address, or opening several accounts;
• ordering prohibited products, or products intended for resale contrary to the declaration of personal use;
• clearly abusive or bad-faith claims;
• insults, threats or aggressive behaviour towards our team, couriers or partners;
• use of robots or attempts to bypass the Site’s protections;
• any other serious breach of these Terms of Use or of the terms of sale.

JYBLY further reserves the right, at its discretion, to refuse to enter into or to continue a relationship with a customer where it has serious and objective reasons to believe that the customer’s actions harm or could harm its business, its security, its partners or its other customers. Unless the law requires otherwise, JYBLY is not obliged to tell the customer the reason for its decision.

A blocked customer can no longer sign in or place orders and is invited to contact customer service. To prevent a block from being bypassed, JYBLY may compare the information linked to accounts (e-mail address, phone number, name, delivery address, device identifier, technical browser signature, IP address) and block any new account opened by the same person, as described in the privacy policy.

Orders already paid by a blocked customer are, at JYBLY’s choice, performed or cancelled and refunded under the refund policy, without prejudice to any action JYBLY may take to obtain compensation for a loss suffered. The customer may ask for the measure to be reviewed by writing to customer service from the Contact page.

6. Store links and brands

Links pasted by users and the information displayed (photos, prices, sizes) come from third-party websites over which JYBLY has no control. Store names and logos are used only to identify the websites where JYBLY can buy; they belong to their owners, and JYBLY is not affiliated with any of them.

7. Intellectual property

The JYBLY brand, logo, texts, illustrations and code of the Site are protected. Any reproduction or reuse without written permission is prohibited.

8. Liability

The information on the Site is provided for guidance and may contain errors or be temporarily unavailable. JYBLY is not liable for damage resulting from use of the Site, an interruption, a virus or the content of third-party websites reached through links.

9. Personal data and cookies

The processing of personal data is described in the privacy policy and the use of cookies in the cookie policy.

10. Support

Users can reach us through the Contact page or, when enabled, through the Site's support widget.

11. Governing law

These Terms of Use are governed by Moroccan law. JYBLY may change them at any time; the online version prevails.
